Landlord uses duct tape to repair broken landings and trips tenant
A property manager used duct tape on a landing at the base of exterior stairs to repair cracked and broken concrete. He left it there for over 6 months, until it deteriorated, lifted up and tripped a tenant. The insurance company supported the property manager in refusing to take responsibility for creating and maintaining an extremely dangerous condition. The jury verdict was over three times the final insurance company offer.
Out of town driver runs red light
A driver from out of town, driving a rental car, looking for an address she had never been to ran a red light striking our client’s vehicle. Despite two independent witnesses and the defendant driver herself admitting she did not know the color of the light when she entered the intersection, her insurance company refused to admit liability. After an arbitration that resulted in an arbitration award in favor of our client, the insurance company rejected the arbitration award, and forced the Plaintiff to go to a jury trial. The verdict was for more than the arbitration award, and the insurance company was forced to pay substantial expert costs and interest in addition to the jury verdict.
Camper shot multiple times by deer hunters
A man out for a stroll while camping was shot multiple times by a group of inexperienced deer hunters. They conspired to blame it on a 16 year old member of the hunting party. We proved through forensic evidence that the 16 year old could not have been the only one firing his weapon in the Plaintiff’s direction, that one member of the party purchased the minor’s weapon unlawfully in the young man’s name [a straw man purchase] and that they were using illegal ammunition. Settlement was made by obtaining policy limits from the homeowners policies of every member of the group.
Hydraulic jack fails while man is changing tire
Our client was assisting a co-worker to change a tire. The small hydraulic jack used to lift the car suddenly failed, causing to vehicle to fall and cause a crush injury to our client's hand. We proved the jack was defectively designed and built, that the manufacturer knew of the defect and changed the design in subsequent models, but failed to warn or pull the defective jacks off of the market. Settlement of 7 figures was obtained for our client.
Utility pole collapses while cable installer is perched on ladder nearby
Plaintiff was doing a cable installation and had perched his ladder on a strand 20 feet off the ground and 5 feet from a nearby utility pole. The utility company had failed to institute or conduct any inspections of its utility poles. The 39 year old pole was rotted at the base and collapsed, sending the Plaintiff into the street and breaking his back. The utility company then collected the pole and despite knowing that the broken pole was evidence, they destroyed the pole. Despite blaming everyone else under the sun for what happened, the utility company paid a substantial amount for all of the Plaintiff’s damages.
Blocked sidewalk forces 80 y/o woman into uneven terrain and injuries
At a large apartment complex, workers’ trucks were parked on a pathway leading into our clients apartment building. The 80 year old plaintiff was forced off of the pathway and into uneven terrain and a broken sprinkler valve in order to get around the trucks. She tripped over the sprinkler valve and fractured her arm. The injury put her in the hospital for an extended period and then convalescent care. She was ultimately unable to live on her own any more and had to move into assisted living. Defendants initially denied the claim, and wound up paying mid 6 figures to settle.
Stacked barrels fall on customer at big box store
Our client was shopping a "big box store" to purchase some half oak barrels that were stacked seven feet high. After he asked an employee for help, the employee accidentally caused the tall stack of barrels to fall on our client, knocking him backwards and into shelving causing a back injury. The bog box store denied liability, and blamed our client for failing to position himself away from the area when the employee was helping him. The big box store and its insurance representatives offered very little money, believing that a jury would not render a high verdict against them because "everyone shops there and loves the store." The client was very afraid of trial because he had heard that the law firm for the defendants "never lose." They lost this one. Big time.
NOTE: Past results are not an indication that any other or similar case will obtain the same result or recovery. Every case is different. These results do provide some rather interesting examples of the wide variety of personal injury cases and claims, and they all show that even though an insurance company claims they will not pay, or that they will pay very little, success can be achieved through diligence, hard work and creative thinking
